1. General

www.doulacare.in (the “Website”) is owned and operated by Narvin Sciences Pvt. Ltd. (the “Company”, “we”, “our” or “us”), which markets the Doula™ range of maternity skincare products. Use of the Website is offered to you subject to your acceptance of all the terms, conditions and notices contained in these Terms, together with any applicable policies incorporated herein by reference, along with any amendments or modifications made by the Company at its sole discretion and posted on the Website.

For the purpose of these Terms, wherever the context so requires, “you” or “User” shall mean any natural or legal person who visits, browses, registers on, or transacts through the Website.

The Company may revise these Terms at any time. The revised Terms shall be made available on the Website, and your continued use of the Website following any change constitutes your acceptance of the revised Terms. You are requested to review these Terms periodically. The Company shall not be required to individually notify you of changes.

By (i) using this Website or any facility or service provided through it in any way, or (ii) merely browsing the Website, you agree that you have read, understood and agreed to be bound by these Terms and the Website’s Privacy Policy, along with such other rules, guidelines and policies as are relevant under applicable Indian law.

The Company shall not be liable to deliver any products purchased by you to locations outside India.

2. Eligibility

Use of the Website is available only to persons who can form legally binding contracts under the Indian Contract Act, 1872. Persons who are “incompetent to contract” within the meaning of the Indian Contract Act, 1872 — including without limitation minors and un-discharged insolvents — are not eligible to use the Website.

Doula™ products are intended for use by adults. If you are below the age of eighteen (18) years, you may use the Website only through and under the supervision of a parent or legal guardian who agrees to be bound by these Terms.

The Company reserves the right to refuse access to, or terminate the account of, any User at any time, without assigning any reason, and you shall have no right to object to the same.

3. Products & Maternity Care Notice

The Website facilitates the online purchase of maternity skincare and personal care products offered by the Company. The sale and purchase of products between you and the Company shall be governed by these Terms.

Important health notice. Doula™ products are cosmetic skincare products formulated to be suitable for use during pregnancy and breastfeeding. They are not medicines and are not intended to diagnose, treat, cure or prevent any disease or medical condition. The information on the Website is provided for general informational purposes and is not a substitute for professional medical advice. If you are pregnant, breastfeeding, or have a known skin condition or allergy, you should consult your gynaecologist or a qualified healthcare professional before use. Discontinue use and seek medical advice if irritation occurs.

The Company makes no warranty that the Website or its services will meet your requirements or be uninterrupted, timely, secure or error-free.

4. User Account, Password & Security

The Website may require you to register an account to avail certain services. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to (a) immediately notify us of any unauthorised use of your account, and (b) ensure that you log out at the end of each session.

You shall ensure that the information provided by you at registration is true, complete, accurate and current. If you provide any information that is untrue, inaccurate, not current or incomplete, the Company reserves the right to suspend or terminate your account and refuse any current or future use of the Website.

You confirm that you are the authorised holder of any card or payment instrument used in transactions on the Website. The Company will not be responsible for any financial loss arising from the misuse of your payment details.

5. Pricing & Payment

The Company strives to provide accurate pricing for all products on the Website. All prices are listed in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise.

  • Your relationship with the Company is on a principal-to-principal basis.

  • By placing an order, you enter into a legally binding and enforceable contract to purchase the product(s) on the payment basis specified at checkout (prepaid or, where available, cash on delivery).

  • The Company reserves the right to refuse or cancel any order, including where a product is listed at an incorrect price due to a technical or typographical error, or where it suspects fraudulent or questionable activity.

  • The Company shall not be liable for any delay or failure in processing a transaction that is beyond its reasonable control.

6. User Obligations & Conduct

Subject to your compliance with these Terms, the Company grants you a personal, non-exclusive, non-transferable, limited privilege to access and use the Website. You agree to use the Website only for lawful purposes and in accordance with these Terms and all applicable laws. You agree that you will not:

  • Defame, abuse, harass, threaten or otherwise violate the legal rights of others;

  • Impersonate any person or entity or misrepresent your affiliation with any person or entity;

  • Upload or transmit any material that is infringing, obscene, defamatory, or unlawful, or that contains viruses or any other harmful code;

  • Use any robot, spider, scraper or other automated means to access the Website or copy any content from it;

  • Attempt to gain unauthorised access to, probe, scan or test the vulnerability of the Website or any connected network, or breach its security measures;

  • Interfere with or disrupt the Website, its servers, or any other person’s use of it;

  • Use the Website or any product purchased through it for any commercial purpose, resale, barter or profit; or

  • Violate any applicable law, regulation, or these Terms.

The Company reserves the right (but assumes no obligation) to review and remove any material you post, and to terminate your access to the Website at any time without notice for any breach of these Terms.

7. Intellectual Property Rights

All content on the Website - including text, graphics, user interfaces, visual interfaces, photographs, artwork, logos, and computer code (collectively, the “Content”) - is owned or controlled by the Company and is protected by copyright, trademark, and other intellectual property laws.

The trademarks, logos and marks displayed on the Website - including Doula™, ItchEase™, and StretchMelt™ - are the property of the Company. You may not use these marks without our prior written consent. You may not copy, reproduce, republish, distribute or create derivative works from any Content without our authorisation.

8. Cancellations, Returns & Refunds

Cancellations, returns and refunds are governed by Part B (Cancellations, Returns & Refunds Policy) of this document, which forms an integral part of these Terms.

9. Disclaimer of Warranties & Limitation of Liability

To the maximum extent permitted by applicable law, the Website, services and materials are provided on an “as is” and “as available” basis without warranty of any kind, whether express, implied or statutory. The Company does not warrant that the Website will be uninterrupted, timely, secure or error-free.

Notwithstanding anything to the contrary, the Company’s entire aggregate liability to you under these Terms, or in connection with any product or service, shall not exceed the amount actually paid by you for the specific product or order giving rise to the claim.

In no event shall the Company, its officers, directors, employees or suppliers be liable for any indirect, incidental, special, consequential or punitive damages whatsoever, including loss of profits or data, arising out of or in connection with your use of the Website.

Nothing in these Terms shall limit or exclude the Company’s liability where such limitation or exclusion is not permitted under applicable law, including the Consumer Protection Act, 2019.

10. Indemnification

You agree to indemnify, defend and hold harmless the Company and its affiliates, agents and employees from and against any and all losses, liabilities, claims, damages, costs and expenses (including reasonable legal fees) arising out of or resulting from your breach of these Terms, your violation of any law, or your violation of any rights of a third party.

11. Termination

These Terms continue to apply until terminated by either you or the Company. The Company may terminate or suspend your access to the Website at any time, with or without notice, if you breach these Terms, if required by law, or for any other reasonable cause. Provisions that by their nature should survive termination shall survive.

12. Governing Law & Jurisdiction

These Terms, and all transactions entered into through the Website, shall be governed by and construed in accordance with the laws of India. You agree that all disputes arising under or in connection with these Terms or the Website shall be subject to the exclusive jurisdiction of the competent courts at Delhi, India.

13. Communications

You expressly agree to receive communications from the Company by way of SMS, email, phone calls and WhatsApp relating to your orders (for example, order confirmation, delivery logistics, and replacement requests), as well as relating to the products and services offered through the Website.

14. General Provisions

Notice. All notices to the Company should be sent to care@doulacare.in.

Assignment. You may not assign or transfer these Terms. The Company’s rights are freely transferable.

Severability. If any provision is found unenforceable, that provision shall be enforced to the maximum extent permissible and the remainder shall continue in full force and effect.

Waiver. Any failure by the Company to enforce any provision shall not constitute a waiver of that provision.

15. Grievance Redressal

For any order-related issue, you may first reach out to us via WhatsApp or email for a real-time resolution. In compliance with the Information Technology Act, 2000 and the Consumer Protection (E-Commerce) Rules, 2020, the details of our Grievance Officer are as follows:

The Grievance Officer shall endeavour to acknowledge user grievances within 48 hours of receipt and to redress them at the earliest, and in no event later than thirty (30) days from the date of receipt.
